How we protect your privacy, what information we collect, and why

Introduction

We at HOUSKI – licensed business (Osek Morshe) no. 311515381 (hereinafter: "the Company", "we") respect the privacy of our customers as well as the users of the services provided by the Company, including via the Website, landing pages and the Company's application (hereinafter: the "Users"; the website, application, banners and landing pages shall together be referred to as: the "Site"; and the "Services").

The information set out below is intended to help Users understand the Company's privacy protection policy.

This Privacy Policy, as detailed below, explains the sources through which the Company collects information about Users of the Site, the purposes for which the Company collects the information, what information is collected about Users, what use the Company may make of the information, how the Company handles and stores the information, and more. Users should note that additional rules may apply to specific services and/or applications, and that a separate privacy policy specific to the use of information collected within those applications may be published.

The information that the User provides to the Company depends on the User's consent and willingness, and there is no legal obligation on the User to provide such information. Nonetheless, without the provision of such information, the Company may be unable to provide the Services to Users in full or in part.

Information provided and/or collected about Users shall be stored in the Company's databases, which are controlled by the Company.

The Company will use the information in accordance with the provisions of this Policy and/or the specific privacy policy of the particular service and/or application the User is using, and in accordance with applicable law.

Use of the Site constitutes the User's consent to this Privacy Policy and to the storage and management of information in such databases.

This Privacy Policy is drafted in masculine form for convenience only and applies equally to all genders.

Section headings in this Policy are provided for the convenience of Users only and shall not be used for interpretation of the sections or for any other purpose.

What is Information?

In this Policy, "Information" means any data relating to an identified or identifiable individual, such as name, address, email address, identification number and additional data, in accordance with the definition of "Personal Information" under the Israeli Privacy Protection Law, 5741-1981 (חוק הגנת הפרטיות, התשמ"א-1981).

Information Collection

In connection with the use of the various Services provided by the Company, the Company collects information about Users as set out below:

  • Browsing the Site: technical information and digital identifiers (as further detailed below in the Cookies section), various contact details provided by the User, including full name, phone number and email, and any other information the User provides to the Company.
  • Purchase of the Company's services, including on the Site: certain services require an agreement, registration and/or the provision of information collected about Users. When the User purchases the Company's services, the Company will collect the following details about the User: full name, identification number, address, contact details (such as email and phone number), photograph, monitoring of purchase processes, including purchase details, purchase history, destinations, consumer preferences, details of guests accompanying the booking, and any other information that the User provides to the Company and/or that is received by the Company in connection with the User.
  • Communications with customer service and Company representatives: information about Users may be collected when contacting the Company, including communications with customer service, such as name, contact details (email and phone number), the content of the inquiry, correspondence with the User, photographs, and any additional information the User provides or that is received by the Company.
  • Job applications: when submitting a job application, the User will provide the Company with information such as name, home address, contact details (email and phone number), CV, employment history and any additional information.
  • Joining the Company's mailing list: when a User requests to join the mailing list, the Company will collect information about the User such as name, contact details, information relating to clicks on banners and landing pages, and similar data.

Purposes and Manner of Use of Information

The Company is entitled to collect information about the User and to use it for the following purposes — in whole or in part:

  • To provide the User with services, and to improve and enrich the services and content offered on the Site, including creating new services and content that may suit Users' needs, as well as to change and/or discontinue existing services and content.
  • To conduct analyses, statistics and surveys, including in connection with promotions and/or services offered by the Company, by those acting on its behalf and/or by third parties with which the Company has partnerships.
  • To tailor the advertisements displayed to Users while visiting the Site and other websites to areas that may be of interest to Users.
  • To manage Users' preferences within their activity on the Site.
  • To manage, support and resolve technical issues.
  • To contact the User and/or send the User direct marketing, marketing information, advertising material, promotions, sales campaigns, newsletters and any other mailing or content, including in connection with the Company's services and products and/or those of third parties with which the Company and/or the group has partnerships, and/or other products or services (whether information published by the Company itself or information received for distribution from other advertisers), all through the Site's notifications system, via email, SMS, WhatsApp, Push notifications, Facebook and other social networks, similar technologies (both existing and future), by telephone and/or through other means of communication and/or media.
  • To contact the User and/or send operational notices, alerts and updates by various means, including email, messages and SMS.
  • To perform checks in relation to Users' activity on the Site and/or the Services, prevention of fraud, operations, security, detection of deception and/or any other unlawful activity.
  • For the purpose of conducting legal proceedings, including but not limited to defending against claims, demands and allegations against the Company and/or the group and those acting on their behalf, as well as against third parties.
  • For any other purpose set out in this Privacy Policy.
  • Information received in connection with job applications will be used for recruitment purposes and for assessing the feasibility of employing the candidate.
  • For the operation and development of the Services and/or the Site.
  • To comply with legal obligations.

The Company is entitled to collect and disclose statistical or anonymous information that does not personally identify the User to third parties, including advertisers, subject to the terms of this Privacy Policy and applicable law.

Transfer of Information

The transfer of information to third parties shall include only relevant information that does not exceed the purposes for which the information is transferred, and shall be carried out proportionately to a defined purpose.

The Company is entitled to transfer the information, or any part thereof, to third parties in any one or more of the following cases:

  • Third parties that provide the Company with various services, including, among others, support services for security systems and information technology (IT) systems, data storage services, survey and research services, external lawyers or other professional advisors, as well as additional third parties that provide services to the Company (including Guesty as the property management provider through which bookings are processed).
  • Third parties that operate advertising services and marketing and advertising platforms, including interactive advertising companies. The Company is entitled to transfer information to such companies, which will use it to tailor marketing offers and targeted advertisements for Users and others on the Site and on other websites and applications across the internet, all in accordance with the privacy policies of those third parties. Please note that such third parties may hold additional information about Users, received by that third party independently of the Company and the Services. The Company has no control, and shall have no control, over the actions performed by such third parties with the information, based on the User's relationship with those third parties.
  • If the Company receives a court order directing it to disclose the User's details or information about the User pursuant to such order and in accordance with applicable law.
  • In any dispute, claim, demand, lawsuit or legal proceedings between the User or anyone on the User's behalf and the Company or anyone on its behalf.
  • In the event of a transfer, sale, assignment, pledge and/or acquisition of the Company and/or its assets and/or any portion thereof, for consideration or otherwise, including in cases where ownership of the Site and/or its content, in whole or in part, is transferred to third parties, including but not limited to a merger of the Company and/or its operations with third parties, and including, without limiting the generality of the foregoing, in cases of a change of control, in whole or in part, of the Company, and in cases where the Company is evaluating the feasibility of any of the foregoing scenarios.
  • In any case where the Company believes that disclosure of the information is necessary to prevent harm to the Company, the User or any third party.

The Company is entitled from time to time to transfer the information to third parties, as set out above, including outside the borders of the State of Israel, including to the United States and to the European Union (in light of the Company's operations in the French Alps), and including to third parties located in countries where the level of data protection differs from that provided under Israeli law. Without derogating from the provisions of this Policy, use of the Site constitutes the User's consent to this Privacy Policy, including to the transfer, storage and retention of information with third parties located outside the borders of the State of Israel.

The Company does not store the User's credit card details. When placing a booking, the User enters credit card details within a frame (iframe) that is linked directly to the website of a third-party service provider of the Company that performs the payment processing, and the Company is not a party to this. The User is subject to the terms of the payment processor, including the privacy policy of the payment processor. The Company has no control, and shall have no control, over the processing of information carried out by the payment processor. The Company shall bear no liability in connection with the processing of information by the payment processor, including with respect to privacy protection, data security and related matters.

The Company will transfer information to various Service Providers, including hotels, aparthotels, airlines, ski resorts, ski instructors at ski resorts, transfer companies, car rental companies, ski and snowboard equipment rental companies, attraction providers, production companies, tourism and ground services providers, and others (hereinafter: "Service Providers"). The User acknowledges that the services of Service Providers are subject to the terms of the Service Providers, including the privacy policies of the Service Providers, and are the responsibility of the Service Providers. The Company has no control, and shall have no control, over the processing of information carried out by the Service Providers. The Company shall bear no liability in connection with the processing of information by the Service Providers, including with respect to the collection, processing and security of information, and related matters.

Data Security

The Company employs technical and physical measures in relation to privacy and data security in accordance with accepted standards. As is known, the storage and transmission of information by electronic means, including via the internet, can never be entirely secure, and any time that the User transmits information to the Company, in particular via the internet, the User does so with full consent and subject to the risks inherent in transmitting information in this manner. In any event, if the User has reason to believe that the transmission of information to the Company is no longer secure (for example, if the User feels that the transmission of information to the Company may have been compromised), please notify the Company by contacting the Company as set out in this Privacy Policy.

Limitation of Liability

The Company shall not bear any obligation and is exempt from all liability in connection with any damage, loss or expense of any kind, whether direct or indirect, incidental or consequential, caused or to be caused to the User and/or any third party in connection with the transfer of information to the Company, with the collection, storage (including in the cloud), processing and transfer of information to third parties, and in connection with the User's use of external applications.

Data Retention Period

The Company will retain information about the User for the period of time necessary to ensure the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law.

Information About Third Parties

If the User provides information to the Company in connection with third parties, including family members and additional guests accompanying the booking, the User declares and undertakes that they have obtained the explicit written consent of such third party to the collection, processing, storage and transfer of the information in accordance with the provisions of the Privacy Policy, and that the Company is entitled to receive, retain and process such third party's information in accordance with the Privacy Policy.

Cookies

The Company may use automated information-gathering tools, including cookies, pixels, SDKs, beacons, tags and the like, which are technologies sent to the device from which the User browses and which automatically store various information files on that device (hereinafter together: the "Cookies"). Without derogating from the foregoing, if a User chooses to provide identifying information on the Site, that information may be linked to the non-identifying information collected on the Site.

The Cookies contain and collect a variety of information, such as the pages the User visited, the length of time the User spent on the Site, content viewed by the User on the Site, the source from which the User arrived at the Site, the User's IP address (i.e., the User's computer address on the internet) including the approximate geographic location derived from it, the number of visits to the Site, characteristics of the User's device or computer including screen resolution, type and version of operating system, type of web browser, its version and language preference, domain names and more. The Company or third parties operating the Cookies may access the information stored in the Cookies from time to time, and such information may be retained on the servers of the Company and/or the third parties.

The Company uses Cookies for the following purposes – in whole or in part: (1) routine operation of the Site; (2) collection of data in connection with use of the Site; (3) improvement of the browsing experience; (4) statistical, research, marketing and commercial purposes; (5) data security; and (6) tailoring content, including marketing content, that may be of interest to the User, also when the User browses other websites.

Cookies are text files that the User's browser creates on command. Some Cookies expire when the browser or relevant application is closed, while others are stored in the memory of the User's device or computer or sent to the Company for the provision of the Services, as described above.

The Company takes precautions to ensure that the Company's computers or those acting on its behalf can read and interpret the information stored therein. Nonetheless, it is clarified that where Cookies are created or operated by third parties, the use and information collected through such Cookies are subject to the privacy policies of those third parties. The Company has no control over the data stored in them or over access to that information, or over its correlation with additional information, and such uses are subject to the privacy policies of those third parties. The Company has no control over the policies of those third parties or over how they implement them, including in cases of requests to opt out of the use of Cookies.

Examples of third-party Cookie use:

  • The Company uses Cookies of Google, such as those implemented using Google Analytics, which assist in tailoring the browsing or use experience for Users and in deriving statistical insights regarding use of the Site. Use of Google Analytics is subject to Google's relevant privacy policy.
  • The Company uses various analytics tools and advertising systems of Google, Facebook and others as tools for measuring the characteristics of Site usage, measuring the effectiveness of advertising campaigns and selecting audiences for campaigns. Additional information on these tools can be found, among other places, in the Cookie policies of those advertising systems.
  • The Company uses, from time to time, tools offered by Taboola, subject to Taboola's relevant privacy policy. Additional information on these tools can be found, among other places, in Taboola's Cookie policy.
  • The Company uses, from time to time, tools offered by TikTok, subject to TikTok's relevant privacy policy. Additional information on these tools can be found, among other places, in TikTok's Cookie policy.

In addition, the Company uses ad personalization services through the Google Signals tool for Google users whose accounts have the Google Ads Personalization option enabled, for the purpose of measuring advertising performance. For this service, the Company may share information about the User with the provider, such as email or phone number, which will be used to identify the User's details and tailor the advertisements the User may see. Details regarding Google's Cookie usage policy and options for controlling the information collected through it can be found in Google's privacy policy.

A User who does not wish for Cookies to be collected on their device can prevent this by changing the browser settings on their device. For this purpose, please refer to the browser's help file. Disabling Cookies may cause some of the services on the Site to become unavailable or their quality to be impaired. It is clarified that deleting existing Cookies does not affect information already stored in Cookies with the Company and with third parties. In addition, and notwithstanding the foregoing, Cookies that are essential and necessary for the operation and management of the Site cannot be disabled.

Minor Users

The Services are intended and designed for use by adult users (over 18 years of age). It is clarified that the Company does not knowingly collect or use any information from minors. If you are a minor, you are requested not to provide information and/or register on the Site and use the Services. In the event that it becomes apparent to the Company that it holds information collected from a minor without the consent of a parent or legal guardian, the Company will act to delete such information promptly.

Right to Access and Correct Information and Privacy Contact

Under the Israeli Privacy Protection Law, 5741-1981 (חוק הגנת הפרטיות, התשמ"א-1981), the User or anyone on the User's behalf is entitled to review the personal information about them held in the Company's databases, and to request that the Company correct this information if it is inaccurate, incomplete, unclear or not up to date. This right may be exercised, and any question and/or clarification regarding this Policy may be directed to the Company, using the contact details set out in this Privacy Policy.

Governing Law and Jurisdiction

The terms and provisions set out in this Privacy Policy, any amendment or modification thereto, as well as use of the Site, shall be governed by the laws of the State of Israel, without reference to its conflict-of-laws provisions. Exclusive jurisdiction in connection with any dispute and/or claim arising in connection with use of the Site and this Privacy Policy, or matters related thereto, is vested solely in the competent courts in Tel Aviv-Yafo.

Miscellaneous

The Company is entitled, at its sole discretion, to update the Privacy Policy from time to time, without any need to provide notice or alert of such update. The updated Privacy Policy will be published on the Site and shall apply from the time of its publication on the Site. It is the User's responsibility to stay informed of any changes made, if any, from time to time to the Privacy Policy.

Continued use of the Site by the User following an update to the Privacy Policy shall constitute the User's consent to the updated Privacy Policy, including to the changes.

If any provision of the Privacy Policy is held to be unenforceable, this shall not affect the remaining provisions of the Privacy Policy, which shall remain in full force and effect. Without derogating from the foregoing, in the event that a provision of the Policy is held to be unenforceable, the provision so determined shall be replaced by a lawful and enforceable provision that is as close as possible in content, purpose and effect to the provision that was determined as set out above.

The User may not assign their rights and/or obligations under the Privacy Policy to any third party. The Company and those acting on its behalf may assign their rights and/or obligations to a third party.

The provisions of the Privacy Policy are in addition to any agreement, consent, terms document and document that exist or may exist between the User and the Company. The provisions of the Privacy Policy are intended to add to, and not to derogate from, the Company's rights under any other agreement and consent between the User and the Company.

Nothing in the Privacy Policy shall derogate from any right granted to the Company and/or those acting on its behalf under any law.
